Father of Major Booked in Shopian Firing Incident Moves Supreme Court Seeking Dismissal of FIR

New Delhi, Feb 8: Father of Major Aditya, who was booked for the death of three civilians in Jammu & Kashmir's Shopian last month, has moved the Supreme Court seeking dismissal of the FIR against his son.

In his petition, the Major's father claimed that his son, member of the 10 Garhwal Rifle, "was not there" when the shooting took place.

To support his claim, he cited the statement released by the Army after the Shopian firing incident, which says Major Aditya was leading an "administrative convoy" away from the site of clash.

The petitioner accused the J&K Police of exhibiting an "arbitrary exercise of power", by naming his son as an accused. He further argued that charging the military personnel "for lawfully discharging their duty" would hurt the morale of the entire force.

"Army personnel present there were doing lawful military duty peacefully and who, by violent actions of the mob, were forced to take lawful actions for protection of government property without any excessive use of force," the petition adds.

The firing in Shopian on January 27 resulted in the death of three civilians. An FIR was lodged against the Army personnel by the J&K Police for firing against the protesters.

Apart from the police complaint, J&K CM Mehbooba Mufti has called for a magisterial inquiry, whose report should be submitted within 20 days.
