Bombay High Court Asks Insurance Company to Pay Rs 30 Lakh Compensation to Woman Who Lost Her Husband in Road Accident, But Was Remarried Within a Year

The court, however, ruled that the status of the wife as a dependent has been considered at the time of the death of her husband and not during the filing of the application for compensation.

Mumbai, December 23: The Bombay High Court has recently asked an insurance firm to pay Rs 30 lakh to a woman who lost her husband in a road accident and got married within a year. According to a Mumbai Mirror report, the High Court ruled that the woman is entitled to the compensation even if the woman remarried within a year of her husband's demise in a road accident.

The court said that the widow can make claims to her compensation irrespective of the status of her marriage. The HC fixed the amount at Rs 29,51,000, which included an increase in the rate of interest from 7 to 9 percent for a period of eight years. The insurance companies argued that the woman was not dependent on her deceased husband's income at the time of filing the claim and therefore, she is not entitled to the compensation.
