Bombay HC Rejects Plea of a Domestic Violence Victim to Terminate Her 21-Week Pregnancy!
According to the report, the woman's doctor fears that her mental health will get affected if she continued with the pregnancy.
Mumbai, June 21: The Bombay High Court has refused to entertain the plea of a 20-year-old woman, who is allegedly a victim of domestic violence to terminate her 21-week 'unwanted' pregnancy. According to a Times of India report, the woman didn't want to get pregnant, until she completed her education and got a job. However, she was a victim of domestic violence, and also made her discontinue her studies. Till her 20th week of pregnancy, she was kept in confinement, and then left her.
She couldn't take contraceptive pills as she has epilepsy, and her husband refused to use contraception. A lawyer quoted in the report said, "We presented this as a case of failed contraception that could be treated as an exception in the Medical Termination of Pregnancy Act, but the court rejected the plea."
According to the report, the woman's doctor fears that her mental health will get affected if she continued with the pregnancy. However, the Court rejected the plea because the woman is married and the foetus has no medical anomaly.
The lawyer representing the woman said that man's family had promised to allow her to study after marriage and that the couple would also wait before having a child. But, they not only forced her to stop education, but was also subjected to violence, and dowry.
