It's a historic day for our nation as Supreme Court has finally termed Section 377 as irrational. The case was being heard by the newly reconstituted bench, headed by Chief Justice Dipak Misra, Justice R F Nariman, A M Khanwilkar, D Y Chandrachud, and Indu Malhotra. On July 17, the Apex Court had reserved its verdict on whether to decriminalise Section 377, the archaic law which criminalises homosexuality. In 2009, the Delhi high court had decriminalised gay sex, ruling that a ban on a consensual sexual relationship between gay men is a violation of fundamental rights. Thus, legalising homosexual acts between consenting adults. However, the Supreme Court had reversed the High Court order in December 2013 and pointed out that those indulging in gay sex will be prosecuted and sentenced under Section 377. However, after strong opposition and numerous debates, the Apex Court, today, has finally scrapped the unwanted article and given a new lease of life to the entire LGBT community.
